Understanding Res Judicata: No Second Trial on the Same Issue
The doctrine of Res Judicata, as per Section 11 of the Code of Civil Procedure, 1908, prevents the same dispute from being tried again once a competent court has adjudicated it.
✔ Finality of Decisions – A matter once decided cannot be reopened in another suit.
✔ Prevents Multiplicity of Litigation – Ensures judicial efficiency by avoiding repetitive trials.
✔ Applies to Civil & Writ Cases – Binds all parties involved in the previous case.
🔹 Legal Insight: If a court has already decided an issue, filing a fresh suit on the same matter will be barred.
