Who is Responsible for Maintaining a Senior Citizen under Law?
Under the Maintenance and Welfare of Parents and Senior Citizens Act, 2007, the duty to maintain a senior citizen is cast upon their "relative" as defined under Section 2(g) of the Act.
A relative means:
Any legal heir of the senior citizen who is in possession of their property or
Would inherit the property upon the senior citizen’s death.

A person who is not a legal heir cannot be treated as a “relative” merely because they are in possession of, or may inherit, the senior citizen’s property in the future.
