Declaratory Suit & Possession
🔹 A declaratory suit without seeking relief of possession is not maintainable where:
• The plaintiff has sold the suit property through a registered sale deed, and
• The defendants are in possession of the property.
📌 Key Legal Position
• A declaration that a sale deed is void or illegal cannot be granted alone.
• Relief of possession is mandatory when the plaintiff is not in possession.
• The plaintiff must prove:
• Fraud, misrepresentation, or invalidity of the sale deed, and
• A subsisting legal right over the property.
❌ Failure to prove fraud or possession renders the suit non-maintainable.
