📌 Advocates’ Documents & Digital Devices — Supreme Court Directions
The Supreme Court has issued significant guidelines regulating the production of documents and digital devices held by advocates, especially those containing confidential client information.
🔑 Key Principles
1️⃣ No Privilege for Client Documents with Advocate
Documents of a client in the advocate’s possession are not protected under Section 132 BSA — in civil or criminal matters.
2️⃣ Criminal Cases
Production must be before the Court under Section 94 BNSS, regulated by Section 165 BSA.
3️⃣ Civil Cases
Governed by Section 165 BSA & Order 16 Rule 7 CPC.
Court will hear objections on production & admissibility from the advocate and client.
4️⃣ Digital Devices — Criminal Proceedings
If police seek device production under Section 94 BNSS, it can only be produced before the jurisdictional Court.
5️⃣ Court Safeguards for Digital Devices
Device opened only after notice to client and hearing objections.
Court ensures secrecy of other client data, allowing disclosure only of relevant data.
6️⃣ Technical Assistance
Advocate/client may take help of a digital expert during device examination.
👨⚖️ Summons to Advocates — Restricted
Advocates may be summoned only where Section 132 BSA exceptions apply.
Prior approval of SP or above required before summoning an advocate.
