💡 When Does Cause of Action Arise Under Section 138 NI Act?

✔ Cheque Dishonour is NOT the Cause of Action – The offence under Section 138 of the Negotiable Instruments Act, 1881 does not arise merely when a cheque is dishonoured.
✔ Legal Requirement – A demand notice must be sent to the drawer within 30 days of dishonour.
✔ Cause of Action – If the drawer fails to pay the amount within 15 days from receiving the notice, only then does the offence arise.
✔ Legal Action – After 15 days, the payee can file a complaint within 30 days before the Magistrate.
