⚖️ Important ruling by the Supreme Court in
Gunjan @ Girija Kumari and Others v. State (NCT of Delhi) and Another
The Court held that for offences under Sections 3(1)(r) & 3(1)(s) of the SC/ST Act, alleged caste-based abuses must occur in a “place within public view.”
If the incident takes place inside a private house, away from public gaze or access, the essential ingredient of “public view” is not fulfilled.
Accordingly, the Supreme Court quashed the proceedings under the SC/ST Act in the present case.
