🧾 Guardianship of Minor’s Property — Jurisdiction
📚 Case: Preethy George P v. NIL, (Kerala HC) (DB)
Act: Guardians and Wards Act, 1890 — Sections 7 & 29
Key Principles:
👩⚖️ District Court has jurisdiction to appoint a guardian for both movable and immovable property of a minor under
Section 7 of the Act.
🏠 Section 29 restricts transfer of immovable property by a guardian without court permission — but does not apply to movable property.
🚫 Family Court has no jurisdiction in matters relating to guardianship of a minor’s property — such issues fall outside Section 7(1)(g) of the Family Courts Act, 1984.
🧩 Essence:
Disputes concerning the property of a minor — whether movable or immovable — must be brought before the District Court, not the Family Court.
